Groupie Connect LLC d/b/a Groupie (“Groupie,” “we,” “us,” or “our”) is committed to maintaining a safe, compliant, and trusted messaging environment. This Messaging Compliance & Anti-Spam Policy governs the use of Groupie’s SMS and MMS messaging platform and applies to all Customers and communications sent through the Services.

This policy is incorporated by reference into the Terms of Use and applies to all messaging activity conducted using the Groupie platform.


1. Scope & Applicability

This policy applies to:

  • All SMS and MMS messages sent using Groupie

  • All Customers using the platform

  • All End Users (recipients of messages sent by Customers)

Groupie provides messaging infrastructure only and does not originate messages on behalf of Customers.


2. Opt-In & Consent Requirements

Groupie enforces a strict opt-in-only messaging model.

Customers must obtain valid, express consent from each End User before sending any SMS or MMS messages. Consent must be:

  • Freely given

  • Specific to the sender

  • Clearly documented

  • Obtained prior to messaging

Consent may not be:

  • Purchased, rented, shared, or transferred

  • Inferred from silence, inactivity, or prior relationships

  • Bundled as a condition of purchase unless legally permitted

Customers are solely responsible for maintaining records of consent and providing proof upon request.


3. Prohibited Messaging Practices

The following activities are strictly prohibited:

  • Sending messages without prior express consent

  • Using third-party, scraped, purchased, or shared contact lists

  • Sending messages unrelated to the purpose for which consent was obtained

  • Sending misleading, deceptive, or fraudulent content

  • Attempting to bypass opt-out mechanisms

  • Re-adding End Users who have opted out

  • Engaging in any activity that violates carrier, aggregator, or regulatory rules

Any violation may result in immediate enforcement action.


4. Definition of Spam

For purposes of this policy, spam includes, but is not limited to:

  • Any unsolicited or unexpected SMS or MMS message

  • Any message sent without valid opt-in consent

  • Any message sent after an End User has opted out

  • Any message sent outside the scope of the original consent

Groupie maintains zero tolerance for spam.


5. Opt-Out & Unsubscribe Handling

All messages sent through Groupie must support immediate opt-out.

End Users may opt out at any time by replying with standard keywords, including:

  • STOP

  • UNSUBSCRIBE

  • CANCEL

  • OPT OUT

Opt-out requests must be honored immediately and permanently.

Once an End User opts out:

  • Their number is added to a global suppression list

  • They may not be re-messaged by any Customer on the platform

  • No further messages may be sent unless new valid consent is obtained


6. HELP & Support Messages

Customers must support the HELP keyword.

Upon receiving HELP, End Users must be provided with:

  • The sender’s identity

  • Contact or support information

  • Instructions for opting out


7. Monitoring, Auditing & Enforcement

Groupie actively monitors messaging activity to:

  • Enforce compliance with this policy

  • Detect spam, abuse, or prohibited content

  • Comply with carrier and regulatory requirements

  • Protect platform integrity

Groupie reserves the right to:

  • Review message content and metadata

  • Request proof of consent

  • Suspend or terminate messaging campaigns

  • Restrict or terminate Customer accounts without notice when required


8. Violations & Consequences

If a violation is suspected or confirmed, Groupie may take one or more of the following actions:

  • Issue a warning or compliance notice

  • Temporarily suspend messaging privileges

  • Terminate the Customer account

  • Forfeit unused credits

  • Report violations to carriers, aggregators, or regulators

Serious or repeated violations may result in permanent termination.


9. Reporting Spam or Abuse

End Users who believe they have received an unsolicited message sent through Groupie may report abuse by contacting:

Please include:

  • Your mobile number

  • Date and time of the message

  • Message content

  • Sender identity (if known)

Reports are handled confidentially and investigated promptly.


10. Legal & Regulatory Compliance

Groupie complies with applicable messaging laws and industry standards, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)

  • CAN-SPAM Act

  • CTIA Messaging Principles & Best Practices

  • A2P 10DLC requirements

  • Carrier and aggregator policies

Customers are independently responsible for ensuring their messaging activities comply with all applicable laws and regulations.


11. Changes to This Policy

Groupie may update this policy from time to time. Material changes will be posted and become effective upon publication.
